1. Booking and Payment
1.1. A non-refundable booking fee/deposit of 50 percent of the shoot fee is required to secure your session date.
1.2. The remaining balance including extras must be paid on the day of the shoot (after completion)
1.3. Bookings are confirmed only after the deposit is received. Session dates are offered on a first-come, first-served basis.
1.4. All payments are to be made via Debit Card, Credit Card or EFT (online) we have a mobile credit card payment facility for stress free card payments, we can also accept EFT in person.
2. Safety and Anti-Scam Procedure
There are criminals and scamsters targeting photographers and to avoid falling prey to scams and criminals… ALL new Clients go through a background check or vetting process to ensure the safety of the photographer, assistant and our gear from theft.
We also require all new Clients and first those making first time bookings… to meet up with us in person, prior to the shoot booking date, not only to discuss the shoot requirements but also to allow us to get to know our client a bit before the shoot.
3. Cancellations and Rescheduling
2.1. If the client cancels the session, the booking fee or package fee is non-refundable.
2.2. If the client reschedules with at least 3 days notice, the booking fee may be applied to a new date (subject to availability).
2.3. Cancellations made within 48 hours of the session may result in a loss of any payments made.
2.4. The photographer reserves the right to reschedule due to illness, unsafe conditions, or unforeseen circumstances.
4. Weather and Location
- Outdoor sessions may be rescheduled due to adverse weather conditions at the photographer’s discretion however a temporary indoors shoot location can be arranged at short notice.
- The client is responsible for obtaining permission, permits as well as venue access fees for specific locations if required.
- Photography packages do not include Travel Fees (Uber)
5. Session Conduct
- The client is responsible for the behavior of all participants during the session.
- The photographer reserves the right to terminate a session if behavior poses safety risks or prevents the session from proceeding professionally.
6. Image Rights and Usage
- All images remain the copyright of the photographer and Gareth Owen Photography.
- The photographer retains the right to use images for portfolio, website, marketing, and social media, unless the client specifically requests otherwise in writing.
- Clients are granted a personal-use license to print and share images for non-commercial use.
- Commercial use (e.g., advertising, resale, publication) requires written permission and may incur additional fees.
- Raw Images/Files are copyright of the photographer and Gareth Owen Photography, and are not given away for free… however the rights to RAW images can be purchased at R5000.00 which will give full ownership and licensed to the new owner.
7. Editing and Delivery
6.1. Basic retouching and colour correction are included, unless indicated.
6.2. Extensive editing (e.g., body reshaping, background changes) are not included yet available at an additional cost
6.3. The photographer will deliver the final edited images within approximately 7-21 days of the session date and depending on workload.
6.4. RAW or unedited files are not provided. (see raw files under image rights)
6.5. The photographer’s artistic style is understood and accepted upon booking.
8. Client Galleries and File Storage
7.1. Digital images will be delivered via cloud services or made available for download via our website,
7.2. Clients are encouraged to back up all digital files. The photographer is not responsible for loss after final delivery.
9. Liability
8.1. The photographer will take all reasonable care but is not liable for circumstances beyond their control (e.g., equipment failure, accidents, weather).
8.2. In the unlikely event of total photographic failure or cancellation by the photographer, liability is limited to a full refund of any payments received.
10. Model Release
9.1. By booking a session, the client grants the photographer permission to use their likeness for promotional and marketing purposes, unless a written request for privacy is made.
9.2. For minors, the parent or guardian must sign a separate Model Release Form.
11. Agreement
By paying the booking fee and/or participating in the photo session, the client acknowledges that they have read, understood, and agree to these Terms and Conditions.
